Gapferry Terms of Service (EULA)

This English version is provided for convenience. In the event of any discrepancy, the Japanese version shall prevail.

These Terms of Service (the "Terms") set out the conditions for using the application "Gapferry" (the "App," including both the Android app and the Windows app, Gapferry Sender) provided by Tybright ("we" or "us"). By downloading, installing, or using the App, you are deemed to have agreed to these Terms.

1. Description of Service

The App provides functionality to send and receive files, without using network communication, by reading a code shown on screen with a camera.

2. Eligibility

No account registration is required to use the App. Users use the App at their own risk.

3. User Responsibility for Data Handling

The App does not retain the content of files it sends or receives once a transfer is complete. Users are responsible for managing files before sending and after receiving them. Users acknowledge in advance that files may be lost due to loss or malfunction of the device, uninstallation of the App, or similar causes.

4. Prohibited Conduct

When using the App, users must not:

• Engage in any act that violates, or may violate, applicable law
• Reverse-engineer, decompile, or disassemble the App, except where expressly permitted by law
• Use the App to infringe the rights of any third party
• Modify or interfere with the App's functionality without authorization

5. Intellectual Property

All copyrights, trademarks, and other intellectual property rights related to the App belong to us or to their rightful owners. These Terms grant users a right to use the App; they do not transfer any intellectual property rights themselves.

6. Disclaimer

To the extent permitted by law, we bear no responsibility for any damages arising from a user's use of the App, including but not limited to data loss, data corruption, or loss of opportunity. The App is provided "as is," with no warranty of any kind, express or implied, as to fitness for a particular purpose, accuracy, or completeness.

7. Changes to or Discontinuation of the Service

We may change, add to, or discontinue the App's functionality without prior notice to users. We bear no responsibility for any damages this causes to users.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any dispute arising in connection with the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
